ISMS Copilot Refund Policy
1. Scope and Relationship to Terms of Service
- This Refund Policy (“Policy”) is incorporated by reference into the ISMS Copilot Terms of Service (“Terms”). If any provision in this Policy conflicts with the Terms, the Terms prevail.
- Capitalized terms not defined in this Policy have the meanings assigned in the Terms or under Applicable Data Protection Law.
- This Policy governs all purchases of ISMS Copilot’s Services, including subscriptions, feature unlocks, and annual or monthly plans. References to “User,” “You,” or “Customer” have the same meaning as in the Terms.
2. General Provisions and EU Context
Digital Service Nature
ISMS Copilot offers AI-driven, intangible compliance tools. Because these are delivered immediately upon purchase or subscription activation, the usual EU “14-day cooling-off period” for consumers (under the EU Consumer Rights Directive) may be partially or fully inapplicable once the Services have been accessed.
B2B Transactions
ISMS Copilot’s clientele is primarily business (B2B) users seeking compliance and information security assistance. If You act as a consumer under EU law, certain statutory rights may apply. Where local consumer laws override this Policy, those laws govern.
Exclusion of UK Usage
As outlined in the Terms, ISMS Copilot does not serve users located in the United Kingdom. Refund requests from users in the UK are handled per the Terms. ISMS Copilot reserves the right to deny or process refunds for UK-based transactions at its sole discretion, given we do not offer Services in that region.
3. Refund Eligibility
Monthly Subscriptions
- ISMS Copilot generally does not offer refunds once a monthly subscription period has commenced.
- If You cancel before the next billing date, You retain access until the end of the current paid month, with no partial or pro-rata refund unless required by law.
Annual Subscriptions
- If You cancel an annual plan prematurely, ISMS Copilot may (but is not obligated to) provide a prorated refund for the unused months, subject to the absence of any violation of the Terms and at ISMS Copilot’s sole discretion.
- Proration typically excludes discounts or promotions originally applied to the purchase.
Usage Limits and Exceptions
- Heavy usage of the intangible Services may consume the core value quickly (e.g., generating numerous policies or chat sessions). ISMS Copilot may refuse refunds under these circumstances.
- Special pilot programs or promotional offers may have unique refund terms that supersede this Policy.
4. Requesting a Refund
Initiation
- Submit refund requests via ISMS Copilot Support. Include details such as subscription ID, purchase date, and reason for requesting a refund.
Review Process
- ISMS Copilot reviews each request in good faith and decides based on this Policy, the Terms, and any legal obligations.
- Approval does not guarantee immediate fund availability; payment processors (e.g., Stripe) handle disbursement timelines, usually 5–10 business days.
Right to Deny
- ISMS Copilot may deny a refund if the Customer has breached the Terms (e.g., unauthorized usage, providing false data).
- ISMS Copilot will not grant refunds if the User cannot prove payment, or if a transaction appears fraudulent or unauthorized.
5. No Guarantee of Refund for Digital Services
Instant Delivery
Because ISMS Copilot’s Services are digital and often yield immediate value (e.g., generated policies, compliance advice), the EU 14-day cooling-off can be waived or limited if You have begun using the Services. Absent mandatory local laws, full or partial refunds might not be available.
No Warranty on Outcomes
ISMS Copilot disclaims any warranty for specific results (e.g., obtaining ISO certification). Dissatisfaction with AI outputs or incomplete success in compliance do not, in themselves, entitle You to a refund unless mandated by local consumer law.
